Trend Alert: Push for WSIB to cover Chronic Mental Illness
On April 27, 2017, the Ontario government tabled Bill 127, the provincial budget. Within the bill, there is wording which would amend the Workplace Safety and Insurance Act to provide that a worker is entitled to benefits for chronic mental stress arising out of the worker’s employment. The key word is “chronic”, since workers are already able to submit a claim for mental stress arising out of an “acute” incident at work. This precedent-setting change to definition would have a major impact to all Ontario employers currently enrolled in WSIB. An analysis of the change will be discussed, as well as how it may potentially impact private long term disability claims.
